Friend had two notations on Chexsystems both from same bank, both with no balance due, just NSF activity. NSF activity was actually a ATM/Debit card that they paid 5 small debits when account was low and charged 20.00 a pop for putting the debit through instead of just denying the attempt at the terminal. Two accounts closed in same month in 8.200. Disputed them directly with CS and one came off. The other CS just ignored. Sent a follow up dispute letter saying remove right away , you are in violation of the FCRA. Green card received back. Applied at local bank, pulled Chexsystems, and the negative notation was still on CR from CS, not marked in dispute. Is this an actionable violation of the FCRA? Would it be appropriate to send an ITS letter at this point? She was not denied the account, since there was no debt and the entry was from over 3 years ago. If she was denied the account, would there be more damages involved. I am sure she would be denied at another bank. This particular bank opens an account after one year on CS with no debt due, and after 3 years even if there is a debt as long as there is no fraud or retail marker. as an aside... If you are on CS and you need an account and it has been over a year since you were first reported to CS, the bank she went to was Union Bank of California, you can apply online. Might be useful info for someone on CS.
