ChexSystems is full of !@~*

    I got denied for an account by a bank because of one entry that falls off my ChexSystems report in March. When I requested my report online, they started sending collection notices for an account I had in 1994, instead of the report I requested. I had to send a certified letter to get the report. The old account they keep sending notices about isn't even on my report.

    Does anyone know if I should send a cease and desist letter - mentioning that the statute of limitations for the debt in my state?

    You don't have to justify a cease and desist demand. It's your right under the law. You can send the letter without mentioning the statute of limitations.

    Have you tried disputing the items on your Chex report? I was listed on Chex and disputed. The item was removed after 30 days.

    I have also heard you are black balled by them if your checks are not in numerical order.
    Any one had this happen to them?

    That shouldn't be...if your checkbook is lost or stolen = out of sequence

    If you have to give a voided check for direct deposit= out of sequence

    So that really doesn't make sense. Seems someone has not told you the whole story!

    Nope not true. They only blackball you if...

    BofA, Wells or Union tire of you as a customer.

    A bank tells them you are a deadbeat.

    You owe money to a bank after 30 days.

    Some cases have been reported that the three culprits listed above will report you IF you try to close an account and go to another bank (I believe BofA was sued for that in a class action).

    The funny thing about all of this is...

    BofA was sued and promised to not be so harsh about accepting people with Chex (I have heard they will still turn down the majority as they put the onus of acceptance on the bank branch managers).

    Union Bank owns a company called NIX Check Cashing. Nix is one of the biggest check cashing firms in the Western U.S. Supposedly, Union Bank pushes NOT ONLY customers with spotty credit or even poor people to this service (as a way to prove to them you are worthy) they do it to Chexsystems prisoners all of the time.

    Wells just doesn't care and I believe they ALSO own a piece of a check cashing service (who's name alludes me at the moment).

    To wrap this up, you won't get reported to CHEX for writing checks out of sequence (I do it all the time, even when I was ON CHEX and found a bank that would take me).

    It just goes to show you that the banking monoliths are out to screw their customers by hanging this CHEX blackmail/blackball list above everybodies heads. It's not a service for spotting frauds, it's a service to put 7 million Americans into a hell that's worse than having a 500 FICO score (at least YOU CAN FIND a loan if you work hard enough, ALL banks will give you crap and treat you like a leper if you are on CHEX).

    According to a site posted by christi the SOL for bad checks is 3 years, not sure what state they are in. Heres the site:

    The account is from 1994...looks like Cease and Desist letter time to me.

    if you are in TX, try Compass Bank, they use TELECHECK, not chexsystems, and they approved me after having been denied SEVERAL accounts from banks due to still being on Chexsystems. If Compass is not for you, try WASHINGTON MUTUAL. WAMU has "second chance checking" for $15 a month, which sux, but its still cheaper than going to those check cashing bloodsuckers!! Try Compass 1st though, they are FREE!!!
