Citi Cards

    I have been trying to get validation on an old ATT Universal card from Citi Cards. I have sent 2nd and 3rd validation requests and yesterday I recieved the following letter:

    Dear.....
    We have received your request.............

    Based on the timeliness of your request and/or availability of the documents, we are respectfully declining your request.

    WHAT NOW!!!

    Obviously, they cannot validate, so what should I do?

    What a great letter for court. This is a clear violation, as they are obligated to validate debts that they are reporting. I'd send their legal department an intent to sue unless they pay/remove. If still no response I'd sue.

    Can't tell from your post if you have already disputed with the 3 bureaus, it seems to me that they could not have possibly truly validated if the creditor is telling you they can't validate.

    Is this a collection agency you're corresponding with or Citibank?

    I've been corresponding with Citi Bank Directly.

    Under Federal law they are not obligated to validate. What state are you in? You might have more luck there.

    But if the records are not available, how are they verifying accuracy?

    Excuse me but that is BS. They technically are not bound by the FDCPA but they ARE required to comply with the FCBA.

    Send another letter stating the FCBA and see if they play the same tune, if they do, then off with their heads.

    I agree, but isn't there a time limit on FCBA violations (i.e. 60 days)?


    You could also ask the CRA for a procedural request for how they verified the Universal account.

    Yes, it is 60 days, and IMHO that is why they made the statement "because of the timeliness".

    Yes. That's what I was thinking, too.

    One thing about Citibank, they are always on top of their stuff when it comes to credit reporting records and know how. The only way I could get any help from them was through a good will adjustment request.

    Ok, well, I'm gonna have to disagree with you on that one. I am in a HUGE fight with them. They are reporting DH currently 120 days past due, stating he was at one time. I have 3 letters from the Office of the Prez that says they can and will report it that way.

    I sent them a letter prior paying history and current status are two different things. They think I'm nuts.

    I have the past 4 statements reporting -0- past due from them, and they are about to get an ITS.

    Is it being reported that way on Equifax only or on all three CRAs?

    I know that Equifax is notorius for keeping people 120+ days past due indefinitely.

    Well, lol, I stand corrected. Go get 'em!!!!

    See, this is more of an Equifax issue, imho. This was talked about a great deal a couple of years ago, though I can't remember by whom. Momof3 comes to mind for some reason.

    You might want to search this board for "Equifax 120 day late" to see where those conversations led to.

    Sorry to butt in ... but by using the cards beyond Aug 2002, did you not agree not to sue Citibank, and be bound by arbitration? I hold a Citi Platinum card too, and I know that all their cards now carry arbitration clauses

    Of course, if you are suing in small claims, I have my answer since I know Citi agreed to waive the arbitration clause for small claims courts

    Haven't used the card in a year.

    Marci - I'm not sure who's issue it is, I have them saying they won't change it, and I am sending EQ their letters that state I am CURRENT, but refusing to change it. That way I may ITS everyone and see who gives me what I want first.

    In the spirit of niceness (although I am sorely lacking with them today), I have a call into Cricket to try one more time. BTW my RMA/Office Depot debacle happens to include Citi as they are the OD card issuer.

    They're gonna hate me.

    Good plan. I agree that something needs to change wrt the way past 120+ day lates are reported as current.

    But I still say search on that. There may be case law against Equifax for the way they count that into credit scoring.

    Visit www.bayhouse.com and do a search there, too.
