I entered into a 1-yr apartment lease w/a friend. She ended up leaving for the summer and never sent her half of the rent, so I was stuck paying all of the rent plus late fees because I couldn't afford it. She finally came back, then left again. But not before she put a hole in the wall and also damaged the door to her bedroom (she locked herself out). She refused to pay the charges so now we both have a civil judgment on our records. She told me she finally paid it but it came back verified and unpaid when I disputed w/the CRAs. I called the apt complex and they are now under new management. They told me they did not have my records. How should I proceed? Does it matter whether or not they have my records if the info is on record w/the courts? I need to figure out how to get this off my credit report b/c I wasn't even responsible for the debt!

You were responsible, khass, if you were listed on the lease unless you had a separate roommate agreement.

Your CR lists who is reporting the debt, send them a validation letter.

Call the courthouse, get a copy of the default judgment and try to have it vacated. If you weren't served, it could be as easy as that.

The same this has happened to me. An apartment complex has a judgment on me, and they are no long in business. The current owners don't have my file. The only thing that is different is that the judgment states that is has been satisfied. I just want it to be removed....

According to bbaure, 98% of judgements are void on their face.....not that he can't be wrong:)
