Civil Suit on TU Report!

    Hello all,

    I finally got my TU report yesterday and discovered that a civil suit filed against me in Jan 2000 is on the report! The suit was one of those bogus personal injury cases resulting from a fender-bender in June 1999; the woman was asking for $9999 (I think at $10K you have the option of having a jury trial). Long story short, the judge found in favor of me, the defendant, and awarded no damages. I called TU today and they are investigating. No wonder I kept getting denied for credit! The suit is listed by TU as a "derogatory public record"--how is it derogatory if no money was paid to the plaintiff? I really want this deleted or updated to reflect the outcome at the very least, as it is Factor #1 for why my TU score (640) is not higher. Anybody out there ever been in this situation? If so, what was your experience? Thanks!

    It is a frequently told tale, I'm afraid. I posted yesterday about a man who sued someone and WON, and it reported as a derog.

    It's under the insurance thread that was running big yesterday.

    You know, I've been researching this, and it seems that if your name appears in court records in conjunction with any type of lawsuit, it is reported as a negative, and the assumption is made that you are at fault somehow.

    We have a right to take someone else to court, and we have no control over whether someone chooses to sue us - even if it's frivolous and the judge throws it out. Why should these be reported as negatives?

    You know, "they" have created an environment where we must deal with credit reports in order to live a decent life - if you want to rent an apartment, get utility service, or phone service, and in many cases insurance, yet they report anything and everything as negatives and make us jump through hoops to get their assumptions "corrected." They control our lives.

    There must be some action that we can take to change this procedure of reporting all court activity as negative. Even if your neighbor sues you because you dog poops in her flowerbed, and it is dismissed you can have your credit trashed with a "negative" public record.

    This whole thing stinks!!!

    BETTER STILL- Why should it even be reported???????

    They do it to lower Fico scores so they can overcharge for loans and insurance.

    There is.
    Make it illegal to report lawsuits.
    Tighten restrictions on what is reportable.
    Sue them personally so that they have a bunch of sutis on their reports .
    Where can I get a few Sue Happy volunteers?

    It is really ridiculous that my credit rating is going to suffer because some sue-happy b@#&h decided 7 months after a very minor traffic accident (and on the advice of her atty) that her neck hurt.

    Guess I'll see what TU says...the woman on the phone seemed to think it could be deleted, but I'm not counting on this to get resolved w/o a fight....

    I would think it would be lawsuit city. But..who knows? After reading the court rulings on other matters, I think the CRA's appoint the judges.

    Wooohoooo!! Got my updated report from TU on Friday and they have deleted the civil suit!!! Hopefully it won't resurface later on. Thanks for your input lbrown and breeze! :)

    Alright!! Keep an eye on it, though. They do come back sometimes, despite all laws not allowing it.

    Thanks. Just that one deletion jumped my TU score from 640 to 728...too bad it's not FICO!
