If you dont feel the attorney is doing his job tell him what you want done or go file a complaint with the bar association.
Are you saying you settled with a CA in 2004 on this account? Any written proof of this? Is your attorney a consumer lawyer that knows FCRA and FDCPA? I have so many questions based on this post.
