CA is claiming that they met the requirement for validation on the day they sent me a letter. Is this correct ? The reason im asking is that the 1st set of invalid validation was sent on the same day one of the ca folks called me to collect on the debt i asked for validation.
it was computer printouts from the ca, IE not validation Im still interested what the law says, i didnt see it defined. Does the validation end with the SENDING of what the CA considers to be valid, or does it end with the customer receiving it ?
(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.
So hes right then about his mailing it being the end in his mind of the validation How about him sending it and calling me the same day ?
Stinks - but IMHO he's within the plain language. Now you just need to pull out the Wollman letter and get to work.
