Hi All! My bk was discharged in January and I just pulled my credit reports... looks like there are quite a few incorrect items on there. They have balances showing on some of the accounts that were included in the bk. There are '120' marks every month on one or two accounts. Some of them are showing as in collections. All of these should have been covered under the bk. What is the best way to get rid of this? Should I write them with a copy of the bk paperwork? Would it be worth hiring a professional to help? My EQ seems to be the most accurate with respect to the bk, it is the other two that have problems. Thanks! Dartol EQ: 626 EX: 652 TU: 598
Here are some posts to read to kind of give you a heads-up. I wanted to see a forum specifically for bk'ers because all lot of our issues are the same but we need a more assistance with the laws and statutes related to bk. So hopefully this will help. btw, I use creditnet quite often and have found much help on this board. http://www.bayhouse.com/credit-forum/forumdisplay.php?s=&forumid=20 http://www.bayhouse.com/credit-forum/showthread.php?s=&threadid=293
First rule - DO NOT send your BK papers to anybody. Start by disputing the accounts with the creditors. tell them they were included in BK and to update their tradelines accordingly. Most of them will comply. For those who don't, send a second letter. If need be, include your BK papers. It doesn't matter too much if the creditors see your BK papers but what you really don't want to do right off the bat is verify with the CRAs that you filed a BK because it makes it more difficult to dispute the actual BK later on.
Thanks for the tips! I will start with just writing a letter then. Actually, they have the info they need anyway. The accounts that are showing balances are already marked as 'included in bankruptcy'. They just need to get rid of the balances. I think that is true for the ones showing late payments as well. What about chargeoffs though? Can they show those during a bk? I had one show up the month after my bk was discharged as well. That does not seem right either. The account was included in the bk. If was included in BK, it should not be listed as a charge-off. The creditor can, however, list it as something like "Discharged in BK/Account charged off". As long as it says it's discharged in BK, it should be fine.
