I just got a certified letter from CMI after I disputed a collection account they have on me from Adelphia, the initial collection amount was $46 and now with this letter they state that their records indicate that Adelphia sent me an itemization on June 18, 2003 which I never recieved, and now this account has an outstanding blance of $146.46 which includes a charge for unreturned equipment valued at $100... What the hell should I do next? I moved from my apartment 1 yr ago and I left my equipment at the apartment but never got a bill or any letter from Adelphia and I did remmeber I paid my last bill. What should I do next? Do I send them another dispute letter? or should I send them a letter asking them to show me proof that this account belongs to me? Or should I contact Adelphia? Anyone or any experts got any ideas? I mean I think they are lying when they said Adelphia sent me an itemization letter unless they sent it to my old address which might be why I never got anything. Help Please -=)
Doesn't matter what the OC sent you - it does not get the CA off the hook for validation: b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

CMI sent me the exact same kind of CMRRR validation letter, good thing I signed for the letter with my wifes name and signature. There letter was a simple paragraph saying I owe OC $130 for a cable service in 2000. Please pay us or send us proof of your fraud alert or police report showing your fraud alert...blah blah... But yet, they couldn't verify when I disputed through TU. We'll see what EX and EQ do for disputing, LB is right. send a no validation estoppel letter then an ITS. They will cave.
