Ok folks listen to this one. I have disputed 2 small accounts on my credit report that do not belong to me and the agency has no record of my name on their file. They will not remove the information unless I supply them with my SS#,Prior address(es) and my maiden name. Today, I get the same request from their attorneys demanding this same information. My position is that you cannot validate these accounts with the information you have and I do NOT believe I should be required to give them any infomation especially my SS# to people I do not know such as the collection agency or their attorney. Where do I stand on this position I have taken, legally ?? Am I required by law to supply them this type of information in order to have this removed from my credit report. Or do you feel this is a weak position. please let me know asap so I can develop an immediate strategy ?? Again, the 2 small accounts are not mine but I do not like being strong armed by either side. It took 3 certified letters over a period of 6 months to get to where we are today. They cannot verify anything without this information and I do not believe I am legally obligated to assist them in this effort. thank you so much for your help,
Have you disputed thru the CRA, and has the CA verified your disputed TL to the CRA? That is one legal threshold for liability by the CA for erroneous information. Otherwise they could claim the CRA made the mistake. Have you requested validation of the listed TL from the CA, specifically requesting the OC, OC account number, date opened, name under which the account was opened, address and other information provided when opened, original date of delinquency and balance when delinquent, etc. and other information appropriate to show misidentification? Is this a medical account? Are they claiming they can't disclose medical billing information for privacy reasons?
I have disputed thru the credit bureau and it came back as confirmed and remains on report....My dispute to the collection agency is NOT reflected on my report thru the credit bureau. I have requested validation and they indicated they could not verify accuracy without more info from me such as SS#, and prior addresses. Its not a medical account and because they are not mine I am really not sure what they are.
If you are certain they are not yours I would file suit for FCRA violation, libel and libel per se. Let THEM assert "Truth" as a defense if they can. You are not obligated to prove who YOU are - the burden of proof that you owe them is on THEM, and they are trying to shift it to you. Realize that if you send them any information they will just enter it into their records and make it look like you are the correct debtor. Keep their records incorrect until you have a hard copy of them.
