Well, apparently, due to Junum disputing my collection accounts, Midwest Collection Service has once again started sending me letters. The account is from 12/95 so it'll be gone next year anyway. They're saying that if I want to clear up this account, to pay it immediately. Yeah, right! Anyway, the letter states: "At this time, a determination must be made with our client as to the status of your acount. If it is your desire to clear your account, upon receipt of this notice remit the balance in full or call our office to make satisfactory arrangements. REMEMBER - It is up to you and the time to act is now!" ROFLMAO! Well, at least I know SOMEONE is actually attempting to verify this. Wish I knew which CRA it is. I'm thinking about trying to negotiate for removal in exchange for payment, but the amount is only $179. It's not like it's some huge amount or anything. Don't think it'll work. Any ideas anyone?
LOL, you know what to do!! Send them "the letter" - "go away and leave me alone." Or, if you want to take up their time, ask them for validation. If this is 6 yrs old, chances are it's past the SOL. Did you check on that already? Expect something like this every time there is activity on your reports. breeze
Make them eat the debt and lump it The answer here (as always) is to make them "eat" the debt, in otherwords, make them forgive it rather than to go through a legal battle they cannot possibly win even if they wanted to spend the time and the money fighting about it. If it's done right, the legal costs to them to hire an attorney, go through discovery and all the rest of it would be enormously greater than $179.00 which they would not receive from you unless they were the original creditor. They would not make $179 even if they bought the debt for pennies on the dollar. So if you can make it far more expensive to fight than to forgive, they forgive, you win both the original issue and can make them take it off your credit report too. This tired old idea of sending round after round of disputes to the credit bureaus just don't cut the mustard because it does nothing at all to get rid of the original debt.

Re: Make them eat the debt and lump it If it's definitely past the SOL then you have a powerful defense in case they take you to court and demand judgement and payment of the debt. But even then, the SOL will do you no good if you fail to show up in court and present the court with that argument. Otherwise, the SOL will not be of much if any benefit to you. As you may know, there are several different SOL(s). One affects the time limit within which they must file a motion for summary judgement, another affects how long the adverse tradeline can be reported against you, ect. The SOL for different types of situations can and usually are different in different states too when it comes to filing lawsuits against you. So you have to know which SOL applies to each type of situation and indebtedness. *************** I just want it gone. I guess I'll send them a validation letter. Sending them a validation letter is the first step in the process of forcing them to forgive the debt and remove it from your credit bureau files. That needs to be your goal, because just getting it off your bureau files does nothing to eliminate the debt and so it can come back to haunt you over and over again. ***************** I would like to see them produce anything with my signature. If you signed any kind of document, then you would not want to see that, while if you did not sign any kind of document whatever, then I can well understand your statement. But some kinds debts can be collected under certain circumstances even if you did not sign any documents.
