Collection Agency Matter

    I am new to this Board and after reading for many hours, I have gleaned a bit of information from all you folks; however, I would like to be walked through my first situation so as not to make a mistake.

    Have a credit card with Cross Country ("CC") that I closed and continued to pay off the $750 balance. About 6 mos. later they sent an unrequested card and reopened the account on their own. My daughter got the card, used it and tore all bills that came in monthly so I was not aware of anything until I began receiving pitiful collection calls at work from them. (Didn't want to jail daughter but put her in long term rehab instead). She put about $600 on the card so that when the bills began arriving it was up to about $1200. I was paying them $75 per month on a balance with interest, late fees and overthelimit fees now up to $3100!!!

    Put the card with Ameridebt (a mistake, I know) and Ameridebt failed to make a payment 1 month and CC threw me out of program (without telling either me or Ameridebt!). I then made a couple of payments to them but missed last December. Called them a week ago to see if they would settle this account but was told that it has been charged off and is now with NCO. (My last payment was in November). She said I would have to deal with NCO.

    Now - I have not yet heard from NCO. What should I do? Should I contact them or should I wait until they contact me? Do I send a Validation Letter to them upon hearing from them (or prior to hearing from them) and do you think they will settle with me or allow me to pay an upfront $750 dollars or so and pay off monthly at $100. Any suggestions would be most appreciated as I don't want to do anything I can't undo.

    Do not call them let them call you. This company thinks it is beyond the rules and at some point they will start violating your rights and then you play hardball. No calls. No validation. SHHHHHhhhhh

    Thanks to all for your responses. I will await hearing from them and inform them that I will not speak to them until they send me all information pertaining to this collection. Then I will send the validation letter.

    I understand what your saying.. but for people who do not, instead of throwing random statements in why not explain yourself a little.. Or if your too busy to type out a reply for people asking questions. Dont respond to a thread..

    For the poster.. It is always recommended to have everything done in writing. A CA will lie to you on the phone, and make several promises it has no intention of keeping. That is why it is always recommended to get it in writing. That way when they dont follow through with what they said they will do. You have some type of recourse.. That being the written statement from the CA

    Bless you! Thank you so much for your help. I will make sure to get everything in writing and not speak about the situation via the phone. You helped a lot.

    Not a problem, I know it can all be over whelming at first.. and LB and George and the old timers here are very educated in this area.. Way more than I myself, I can only speak of my personal experiences... and what I have read and learned here... They just answer so many questions everyday, they get a little tired of answering the same ones.. I am sure when I am here over a year.. I may very well do the same thing.. and may have forgotten how scary or frustrating this whole process of cleaning up a credit report can be, as by this point it has become second nature to alot of the people here.. Good luck and I assure you it will get easier as you get more use to this whole process
