I am wondering if anyone else has had this situation... I received one notice from a collection agency regarding a bill of which I had heard nothing about until receiving that notice. Of course I was horrified and paid the bill within two days of receiving the notice. Well, I checked my credit reports, and the collection agency had reported the collection two months before I ever got the notice! Also, they did not include any statements in the notice about my rights to request validation (which I unfortunately did not know about at the time). Can I dispute the credit report item since I knew nothing about it when they reported it? Any advice would be appreciated. thanks
You may want to read Spears v. Brennan http://www.state.in.us/judiciary/opinions/archive/03260101.ewn.html
This is pretty difficult to follow. Does this mean that the debt collector won in this case? (Spears vs Brennan)
lbrown, Did you even take the time to read it? Read the CONCLUSION at the end of the document. It really is not hard to follow. Affirmed in part, reversed in part and remanded for further proceedings.
Trust me, I read it.. took about 1 hour! The conclusion is the HARDEST part to follow. I have no idea what a 'reversal' is, and 'remanded'. Is that sort of like wrestling when they do a reversal?
Thanks for the info, Jeff. I read it, and although it's not generally conclusive on the notice, it does give me more of a basis to go on in my dispute. So thanks again!
