Collection Agency

    I had a collection agency tell me that they could not remove a trade line even if the bill was paid. Is this true?

    I tried to negociate payment in full if the tradeline was removed, but the Collection Agency told me they could not remove the tradeline per contract with the CRA's.

    Did you tell them no delete no pay.
    If they want the money they will find a way around the contract that is if in fact there is any such contract.

    Their contract with the CRA's is one thing...

    However, under the FCRA, there is no requirement that they report, EVER, only that if they do report, that they report 100% COMPLETELY AND ACCURATELY, 100% VERIFIABLE INFORMATION.

    Some CA's go the step above saying that they just can't to representing that it is ILLEGAL for them to delete. That's the false and misleading representation... :) If they say that its against their contract, and not against the law that's a different matter.

    Now, ask if they would VERIFY the trade line if it was paid? Technically it would not be violating their agreement with the CRA's if they just abandon the trade line, while you would send a dispute to the CRA.
