Question all: I have a friend who was intimidated by collection agencies till she paid amounts that were already aged over 5 years. I immediately suggested she stop payment on those post-dated electronic checks and I go to work removing the items from her credit. Do any of you know links on this board to dunning letters that I can send the collection folks requesting validation as well as cease and desist contacting her via telephone. Also, what approach should I take now that she attempted to pay but stopped payment on the collection accounts. I am planning to disopute them immediately to prevent a judgment, yet it would seem that their reply to validation will simply be that she 'tried to pay them'. Can I just say she was confused??? By paying, she probably restarted the SOL on collecting (but not on the reporting period). She should start the validation process (see the sample letters section or do a board search). Kemcos said, " I am planning to disopute them immediately to prevent a judgment,..." If the creditors decide to go after a judgement, disputing with the CRAs isn't going to help (I assume that's what you mean by disputing them?).

Well that is not the best suggestion by a long shot. Banks can stop payment on paper checks quite successfully but electronic checks are not all that successful at all. You had best advise her to close that account and open a new one with her bank. That is the only sure way. Don't tell them anything. Just demand validation and nothing more. May be appropriate????
