Hello, Can someone please advise me as to what letter to use to get these idiots off my back. They are calling my work and home but have never mailed anything to me. I have a payday loan of $317 that i had a bounced check on. They will not accept 2 payments on this and want all $317 by tomorrow. How do I keep them from calling anyone where I work, etc? Also, they said they would have me arrested because my ACH they tried to do bounced from my account. Since this is a loan (2 week one) wouldn't't this only be a civil matter? Please help..
First, DO NOT answer any questions on the phone. Tell them you need to check your records and you will get back to them by US mail. Talk to them only to get their company name and address. There are sample letters on "validation" that you need to look up. Also, include a limited cease and desist with your validation request where you tell them to communicate via US mail only. You have rights, you need to exercise them. You should also look up the 1 - 2 punch after you send your validation letter using CMRRR (Certified Mail Return Receipt Requested) and get the green card back if your credit reports are an issue. These people have laws they have to obey and you can actually get money from them if they violate them. Read, read, and read more.
