Collection Company Need Help Fast

    I received a letter today from Trnsatlantic Adjustment Corporation that said they are collecting a debt for SWB for $70. The money that they say I owe is from an old phone that was disconnected and a bill I thought I resolved with SWB. Anyway after the a-hole at TAC yelled at me I told him to send me validation and he said under the law he didn't have to, he just had to refer me back to the original creditor and in 30 days if I don't pay them they are going to put it on my credit report. Is there any truth to that....Sorry this was so long

    What should I do?

    Well, one way to go would be to pay their blackmail and keep it off your report. They have already committed the first violation by telling you to pay them after you requested validation.

    Did the letter contain the mini-miranda? If not, they have 5 from the first communication to provide it. If you request validation and they put it on your report before providing it, that's another violation.

    He is full of total crap. First off it is illegal for him to even yell at you. Get a tape recorder($20 at walmart) and one of those suction cup microphones($5 at radio shack) that you put on the back of your phone. Look at the below site and make sure you are both in a one party consent state.

    Immediately send out a validation letter and include a cease/desist letter in it. Place the recorder next to the phone and record their conversations.

    Have you even contacted the OC, SWB or something like that...?

    If you did indeed pay this bill, I would call them.

    If you didn't pay it, I would still call them and report the action of the CA and tell them that not only will you sue the dog they unleashed on you, you will also sue their asses as well.

    This behavior is not to be tolerated!!!

    Thanks for the info...I am sending the validation letter tomorrow and will be on the phone to SWB bright and early...One more thing I forgot to say is that as soon as I received the letter I called them and asked to speak to the person whose name was on the letter but instead had the displeasure of talking to his assistant or whatever who told me since I knew about the charge I admitted to owing it and had to pay it! By the way I am in Texas!

    you should NOT be talking to them on the phone. Tell them all communication must be through writing.

    The SOL in texas is 4 years. What is the date of last activity on this bill. That would help us if we knew.

    The last date was 4/2001..what if the SOL is out?

    the sol will not be out until 2005 then.You now have some decisions to make. You could firstly call the OC and see if you can find out what happened. you could also validate the debt. On a debt that small you could always try and negotiate with them stating you will pay for full deletion. Tell them a nice sob story(some will listen and some will not) and say you were told there was no bill but because it is so small you would pay but you are very concerned about the damage to your credit report since it was not your fault to begin with. of course this means you have to talk to them which is not good. Save that until last resort.

    I am going to bed now but for the life of me I cannot find this CA you are talking about. Did they leave any other info like state they are in, phone #, any other names, address,ect.
