Please help me with questions. I have recieved a letter from NCO collection agency 6 month ago,and after talking to them on the phone, we did not agree about settelment, then I never talked to them again.Now about two weeks ago I recieved a letter from different collection agency trying to collect the same debt that I own to original creditor.So I know this is the same debt that NCO try to collect from me,and also the NCO stop calling. I only owne one debt.Ok, this is what the letter said that I got two weeks ago from the new collection agency: You account has been assigned to us for collection.I suggest you that you consult with your attorney about what the law in your state will allow our client to do recover the monies you owned and the further consequences of nonpayment. So I called them and I ask to send me a proof of the debt.I also send a certified letter asking them to send me a copy of the original contract of the debt.About 4 days ago I got a letter from them in the mail with the copy of the contract of my original debt,and two days later I got another letter that has the same thing just the copy of the original debt. Ok. I know I own a debt to the original company,but I know I have tryed to settel with original cerditor before but no luck the won't wright me a contract about setteling antill the get my checking account number,and first payment.I also tryed to deal with a second collection company about the same debt,but also no luck. Please can anybody let me know what to do next to get this fixed? Do I send another certified letter to them asking them again about a proof of the debt? Do I deal with them and try to see if the settel,or just not talk to the them? How about what they said in the letter is that means anything or they just trying to scare me? They are saying that my debt was singned to them, is that mean I can still deal with the original creditor about my debt,or is it means they did buy my debt? How I know if they did buy my debt? Do I send them any in the mail? Do I send a settelment offer in the mail? Please help, thank you so much I realy want to fix this.
I wouldn't just ignore the CA, and there's no need to send another DV. It sounds like they've already responded adequately. You probably won't be able to deal with the OC at this point, so keep your communication in writing and send a settlement letter to the CA. "Assigned" means that they haven't purchased the debt, but you can always call them and try to find out who has assigned the debt to them for collection. I'm a bit unclear in your situation because you said NCO has already tried to previously collect. Perhaps the debt was sent back to the OC because they were unsuccessful and then reassigned to a new CA? I'm guessing that's what has happened. Don't get sidetracked by any of their scare tactics either. There's very little need to obtain an attorney at this point in the process. Make an offer you can afford in writing and await their response.

I would send any settlement offer certified so you have proof of delivery. And if you're prepared to deal with this now instead of letting it drag on, why not set the stage by making an offer you can afford first?

I also received 2 letters a day a go from the the collection company and, one of them it the same as the first one they send me like I mention on my first thread. The second letter said : CRS offers you ability to redeem your credit and making it possible to settel for a fraction of that is owed.You must not hesited and lose this opportunity to save money and effect a reporting change to your credit file. call now,don't pass up the chance. So, what is all this mean,and also what the meaning of reporting change to your credit file? They want me to calle them is it good idea to calle,or is it best to send them a letters? Thanks so much.
NEVER PAY A COLLECTION AGENCY!!! Never, never, never. Each time you get a letter from a collection agency regarding a debt that has already been charged off, send them a "Notice to Cease and Desist". If they report to the credit bureaus, simply dispute it (but only after you have sent the notice). Most companies follow the general accepted accounting practice, which means a debt must be charged to profit and loss after it becomes more than 120 days delinquent. Once this happens, the debt goes through a world-wind of being sold from one collection agency to another. If you pay any collection agency for the debt, your account will be noted "paid after charge off". This means you will have a bad mark on your credit which carries the same weight as if it was unpaid.
