Collection for business or personal

    Can a collection agency report to your CRA if you bought the product or the amount was for a business with a business name? Not your own name ??? Just wondering..... i purchased a ad that I disputed and refused to pay.....got credit on my card for it but now they are trying to have a collection agency get it out of me...... but the amount noticed is addressed to my co. not me personally.........thanks all

    Wow I am hearing more and more about this sort of situation. The Fair Credit Billing Act applies in this case, I believe. It seems to me it would be illegal for the company to sell the debt to a CA, when your card company ruled in your favor when you disputed.

    I would file a complaint with AG, and FTC. This is similar to the CA's who buy debts that have been included in bk.

    Actually, I believe it all depends on what type of business it is...corporation, partnership, sole ownership, etc. Also, if you signed a personal guarantee this also comes into play. The personal guarantee (P.G.) basically states that if the company does not pay, that the guarantor will. If there isn't any P.G. and the organization is a corporation or partnership a limited liability (corporate veil) is involved and they can only go after the business. Unfortunately, most corporate CCs don't work like this, because most require a P.G.
