Collection reinserted?

    Who should I go after, the CA or the CRA?

    Item 1: Disputed with CRA, deleted 2/13/02. Today, the same account reappears on my report except that the account number has been changed.

    Item 2: Disputed with CRA, and CRA verified 2/13/02. Today, the original account is still there and a duplicate also appeared (maybe with a new account number.)

    Item 3: Disputed with CRA, and CRA verified 2/13/02. Same as item 2, definitely has a new account number.

    By the way, these are all from the same collection agency. So basically, I started with three accounts, went down to two accounts, and now I have FIVE!!!

    So what do I do? The CRA didn't technically reinsert the same accounts because they have shown up with new account numbers. Can I go after the CA somehow??

    Not an expert here but I would send validation on all 5 accounts. Myself personally, I'd send all on different days - that way it avoids one person from handling all the validations.

    BTW - This wouldn't be Credit Management Inc would it? I'm currently fighting them...

    No this company is out of Austin. I am also fighting with CMI on another issue.

    Don't you think that the CA is violating some law? They were forced to delete an account so they just gave it a new number!

    I am going through the same thing with First Credit Solutions.. I am going to sue them next.

    Under what law are you able to sue them? Could you please point me in the right direction?

    violation of FDCPA.. look for LKH's lawsuit messages..

    You can go after the CRA for FCRA violations (reinsertion without being notified within 5 days). There isn't much to do with the CA unless they have reagged the debt, OR you have already sent validations and they didnt respond to you, but they did to the CRA.

    Under normal circumstances, I would agree with you, but if the ca did change the acct. #'s, it's not the cra's that are in violation. I say send the validation letter for each acct. If they don't respond in 30 days and follow the FDCPA to the nth degree as far as reporting it as disputed, I would sue them on the 31st day.

    The CRA's still need to verify with the Collection Agencies about accounts. even though they are the CA and creditors stooges, they still need to be taught a lesson. Bust them both on FDCPA and FCRA violations.

    Maybe I should start reading someones entire post before responding...lol. I missed the "changed the account number" part. I was at a friends house and I was just checking the board (pathetic huh?)
