Background Info -- a CC account was opened in my name by someone else in my family w/o my consent. Account went to collections. I never knew about account until I got a letter from a collections company. I spoke with collections company and explained this -- they basically told he to file fraud against family member or pay it. I went back to original creditor, eventually got to speak with someone. Original creditor agreed the account should not be in my name, agreed to have it removed from my name. Sent me a letter saying they would advise credit reporting companies of this within 30-60 days. In the meantime, the family member was put in touch with the collection company and I guess they paid like 1/2 of what they owed, i dont know exactly what was arranged. I guess now they are trying to get more money, because now I am getting calls everyday again. Todays message was, "Please call me at XXX-XXXX. Mr.XXXX you can either handle this matter or it will handle you." wtf is that suppose to mean. I guess my question is how can I get this collections agency to leave me alone?
Fax or send them a copy of the letter from the original creditor releasing you from the account. Attach a cease and desist letter and explain that the creditor has released you from the account.
Whatever you do, DO NOT erase that message. With a little luck, it will cost these scumbags some money. Whatever letters you send them, be sure to do it CMRRR. That way you can prove that they received the letters. They will most likely rack up more violations.
"Handle this or it will handle you" is as vague as a threat as they can make, technically, it will handle you could encompass everything from having it sit on your credit report for the remainder of the 7 year reporting period; to legal remedies... the key is that as long as they are that vague, they can't get hammered for false threats of legal action...
