collector putting an inquiry?

    can they do this? I just saw an inquiry from this collectory yesterday on my credit report. Does this count against me?

    If it was a hard inquiry - yes it will count against you in points off your score.
    If it was a soft one or one of those account review inquiries it will not.

    And yes, they have a permissible purpose to pull. It's probably a hard pull, so it will affect your score.

    Have you received anything from the CA yet?

    IMHO they only have a PP to pull if and only if they can validate.

    Enigma raise a good point. However, that would be an implied violation insofar as there is no express language that covers this topic.

    It may well be a topic of first impression under the right facts.

    A well plead argument, coupled with the economics of litigation and the burden of discovery, usually leads to a favorable response.

    I agree and the description of "burden" surrounding discovery is spot on.

    Many a case are settled by simply serving a good set of interrogatories, requests, and admissions. It really is better to just serve it with the Complaint is allowed in the jurisdiction.
