I have been paying $50 to a CA for 2 years and recently received a letter saying I have failed to make payments in accordance with agreement. My payments are due the 15th of each month and I have all records of payments. They say that some were received after the 15th, thus do not qualify? They suggested they draw payments out of my bank acct.
Don't give any CA direct access to your bank account. Did they give you a breakdown of what payments they received on time and which ones they received late?
They didn't give/send me anything, just that I am in default. I called them and they said my money orders were often late, that's all. They wanted to take it from my bank acct which as you say is not a good idea. I pay on the 15th and usually send around the 14th, which may explain it? My only choices are either start a new account at a bank or send my checks around the 10th of each month? I always sent money orders thinking that's the best way?
Making payments by money order is fine, but you do need to make sure they arrive in time. Find out exactly what you need to do to get your account out of default, but I still wouldn't give them any direct access to your bank account. That's just asking for trouble.
Probably when you negotiate with them about your default, you can show them any record or receipt that you send your money order on the 14th. At least you are sending ahead of due date. If ever one day in advance is not enough to reach their office on the 15th, tell them you will make the necessary adjustments and that they consider your previous payments not a default and bring back your account to being up-to-date.
Yes, I sent one 6 days in advance, checked USPS and their time was 4 days. Will call them on 6th day to confirm.
