I have 5 medical accounts with a Credit Bureau of Ukiah. 4 of which have been paid but are still reported as owing. My main concern right now is the 5th one. I disputed it with the Drs. office before they turned it over to the CB. Never would show me what the charges were for or inform me why Medical wasn't billed for the charges totaling $1500.00. I recently tried to dispute it with the CB. I asked them to send me validation. They sent me pages of dates and what happened that day. But no signitures. Actually it would show a date and that insurance payment was credited, then on the same date that the amount was reassigned. Confusing. The first page says - Total due on all accounts:$1903.40 In answer to your request, this account balance is: $117.33 Enclosed is a copy of the itemized statement. Can I use this to pay them $117.33 and be done with it? How? I have also disputed it with Equifax. Who do I dispute SOLs with? I've already told them the sol has run out on the paid accounts that shouldn't be there anyway. Please help as I would like to get rid of them as soon as possible but can't seem to get any where.
Ok, I jumped the gun a little. I'm a newbie. I had very good credit until my emphysema was diagnosed and things started going down hill from there. The credit bureau of ukiah has been under investigation before, and are hard to deal with. But then I was using reason. I paid the accounts to the OC because I had sat down with them and went over my proofs of payments and they're records. It was determined that the accounts should not have gone to the collection agency. But they said there was nothing they could do about it. I couldn't get them to contact each other or ANYTHING and eventually gave up. These were accounts from 1997. The other account they have I have already explained. I had to quit work all together and am now on Social Security Disability. Doesn't pay as much as I need to meet my obligations. So I have 2 charge offs, one a bank loan and a Visa with the same bank. Another in collection with Credit Services over a credit card balance. I have learned to live within my budget and would like to take advantage of one of the very low income housing programs available now. So I am trying to figure out the best way to go about this. Experian report said my credit score is 629, what ever that means. Thanks for your patience ahead of time.
Thank you for taking the time to read my post. Doesn't answer what I should do about the bogus validation reply I got from CA. On one hand I could send another validation request, on the other I could pay the $117. But I'm afraid there may be holes in that therory. Letter not signed, no account number ect..
first of all, the medical collections. Do you have proof you paid them all? exactly HOW & by WHOM was it determined that these shouldnt have gone to collection? Oh, and there is PLENTY the OC can do if they determine that it shouldnt have gone to the CA in the first place. Send them a letter asking them to withdraw the accounts from the CAs, along with whatever proof you have, and be polite about but tell them if they dont withdraw the accounts, you will be forced to "explore your legal options" as your credit rating is being ruined by their mistake. Have you disputed with CRAs? If not, do so now. If it truly is past the SOL (and not just past the 7-yr reporting period--sometimes people get those confused) you need to send a letter to the CA, letting them know this. These medical collections sound like a case of people just not doing their jobs. you have to make them. Have you run across WhyChats SOL info? here's a link: http://community-2.webtv.net/YCHANGE/STORAGE/page13.html As for the chargeoffs, more info is needed. What is it youre trying to do with them? Have you disputed them with CRAs or asked for validation from CAs?
Thank you VERY much for replying! As far as the medical bills I seem to be on track with what you suggested. I've sent so many letters to them before but these Form letters, sort of speak, will do a lot better. ( I hope) I sent them a certified letter providing proof that I had disputed the Dr.s account both with him and them (CA). They had said I didn't. I also requested validation of the debt. They sent me something very odd. The cover letter only states: Total due on all accounts: $1903.40 In answer to your request, this account balance is: $117.33 Enclosed is a copy of the itemized statement. Of course they didn't sign it and there is no account number. The total for the account according to the itemized statement is $1480. I don't exactly know what to do with it. Just ignore it and send a real validation letter? They didn't mention the SOLs, 4 years both in Nebraska and California. So I will send SOLs again. The charge offs were a surprise to me. The Credit Union charged off a loan without any discussion after I sent them a letter telling them of my situation. The second was a Visa account I had with them and have been current on. I only knew this when I pulled my credit reports. On the phone they said they did it because I didn't pay my loan. Told them I would pay them if they took the charge off - off the Visa account. If not I wouldn't gain anything by continuing to pay. But have heard nothing from that. I would like to pay them but have other places for the money to go if I'm still going to be punished for it.
This is all very confusing and contradictory. I'm thinking that it means the total of the 5th unpaid bill was $1480 but you only owe 117 on it? Doesn't really matter, as they are all past SOL. Plus I'm assuming you have proof that the others are paid anyway, right? Do you have proof that they are from 1997? What month in 97? Is there a DOLA or "Date of Original Delinquency" on your credit report? Check that and dispute it if its incorrect. This mess just needs a good SOL letter sent to the CA, and an 'obsolete' letter to the CRA. Now about the chargeoffs... Thats why they charged it off. You hadnt been making payments, and came right out and told them you couldnt, right? They knew it was the only thing they could do. They could have at least contacted you and warned you first, but they didnt have to. Well, which is it? did you pay or didnt you? You say you did, they say you didnt. Do you have proof you've been paying? If you werent paying consistently, they probably figured it was best to charge it off, so they could write that off too. You're exactly right about it doing you absolutely no good to pay them--unless they're willing to delete in exchange for payment. Question is, can you afford to pay it in your situation? they'll probably want a lump sum right now.

I was paying on the Visa and am up to date on it. They say it was charged off because I wasn't paying on my signature loan (the other charge off) I have no argument about that charge off. Just that they charged off the Visa when I am making payments and didn't tell me about it. And you have a point - no, I couldn't come up with a lump sum, just the monthly payment. I am dealing with Credit Services on another credit card account. Got a letter today saying they would work out a payment plan on an amount that is $1250 more than the original debt. Sending them an offer of $25 a month on the original debt. It's what I can afford. I am in the process of making up the SOL letters. Thanks for the input!
Re: Re: Confused about Validation do you have proof? let me get this straight....you have two accounts with this credit union...one's a CC and one's a signature loan....since you defaulted on the signature loan, they charged off both accounts, even tho you were up to date on the CC account? That is really strange. I don't think they can do that. Can they? anyone know? is this also a chargeoff? what is the original debt amount? Have you thought about how long it will take you to pay off that amount at 25 bucks/mo? What is the date of original delinquency on this? when did it charge off? the reason I ask is, if the date of original delinquency is say, 2 years ago, and the amount is $2,000.00, it will take you 80 months to pay it back. thats longer than if you just waited for it to fall off on its own! Also, a lot of the time, a CA will say they'll agree to something like that, and then later, when you think you've paid them in full, they say 'huh? what agreement? you still owe us thousands of dollars." and then they do an evil laugh like the witch on Wizard of Oz. kidding. anyway... my point is: Whatever you decide to do, GET EVERYTHING IN WRITING.
Re: Re: Re: Confused about Validation No, this is not a charge off - I'd like to be able to keep it from being one. But I can't afford the $110 to $500 a month they are talking about. (I get $862 a month Social Security Disability) You were about right on your figures. But then if I eat macaroni every day and don't drive anywhere and paid the $110 a month I could have it paid off in 20 months. I suppose that would be the way to go to keep my credit from getting any worse. I would REALLY like to get into a small home through the Fannie Mae/Hud low income programs. I don't have anything to leave my daughter when I go. But I have to do that as soon as possibly possible. Plus I lived on a mountain very much in the country for six years and now I'm in an apartment complex that reminds me very much of a old peoples home, completely surrounded by buildings. Am I dreaming too big?
Re: Re: Re: Re: Confused about Validation Well, if its not charged off, and they're willing to take 25/mo to keep it from becoming one, you should take the deal IMO. Several months of timely payments will do wonders for your credit rating, even tho it will take you forever to pay it off. its much better than a chargeoff. This is really not my area of expertise, but I would think that in order for anyone to get a home loan, all chargeoffs & collections would have to be paid first, regardless of the type of loan.
Re: Re: Re: Re: Confused about Validation Well, thank you for all your time and trouble. I'll do what I can with my credit and see if I can find a place to rent in the country. I've known in the back of my mind this was a long shot but hey miracles happen. Thanks again.
