I declared Chapter 7 bk 2 years ago.Most of the accounts that were on the BK are not listed that way on credit report . The BK itself is not even listed on my EQ report.I researched and read for a long time before doing anything then I actually read my BK papers none of the OC's were on my BK only their CA's so I didnt know where to start. Any way I went to the lawyer today he told me not to worry that ca's have a duty to report it to the OC and to send a copy of my BK matrix,discharge order and a note saying they are in violatin of the FDCPA,FCRA and also in violation of the BK provision relating to the disharge of the creditors listed on the matrix and if not corrected I will hire an attorney to sue for all violations and damages this has caused.I am supposed to mail this to each creditor and the CRA that reported it.I also told him I wanted to sue one imparticular finance company that KNEW I had filed BK ( I filed the day before I was to appear in small claims court with them) He said I still had to give notice of the mistake before I could sue. OK heres my question: Does this sound right?or is he blowing me off because he wouldnt make alot of money off it?(I don't want to spend another $200 for consult fee for nothing) Thank you for any advice
Deirdre, He's not blowing you off; he wouldn't make a lot of money off of it; however, he's not charging you for doing it for you either. He's instead giving you the ammunition to do it yourself. Don't forget to send them certified RRR. Sassy
