I am confused about this deleting positives tradeline business. If I remember correctly from the FCRA, dont consumers have the right to request that positive information be added to their credit reports. IF so, why cant we send the credit bureaus a copy of the report BEFORE they made the deletions and request that they put the items back? I havent had any positives deleted to my knowledge but I just to know.
Consumers have a right to have things added but the request to have things added must be made TO THE CREDITOR and not the CRA's despite the fact that the item had previously been on the report. That is the word from Equifax and Experian. Now, Equifax has been the worst for me in deleting positive things and so far I got one put back on but only by having the creditor do it. I am going to contact another creditor this week of which two accounts were deleted. I've banked with this company for 20 yrs so they will take care of it, I'm sure. The CRA's won't budge as I've tried for about 6 wks with them on the issue. Now, in thinking about this I have another theory and we might want to watch how mad we get about this and how loud we scream. I do still think they are playing tit for tat games here as I've said before but there is something else that may be going on... The CRA's don't like the 30day limit on investigations. In my case the deletions to two of the trade lines occured after I questioned stupid details about them. I never would have imagined that they would feel a need to contact a creditor in order to answer my questions but they decided to do so or at least to claim that they had to do that. This is where we get to the 30 day issue. Both times they said the creditor did not get back to them in time, needed more time to find the old file, blah, blah, blah... Probably bs but ok, that's what they tell me. So, what are they setting up here? Maybe they want us to whine about the positive deletions to the FTC so they can then say, "Mr. Senator, 30 days is simply not enough time for the creditors to verify things, positive or negative. Because we have to provide verification under the FCRA in ONLY 30 days and the creditors cannot finish their research in that time the only thing we can do is remove the tradeline." The FTC and our Senators and/or Representatives then change the verification to 45 days or even 60 days! Do I sound like a Conspiracy Theorist or what??? After reading this board for 60 days (long past current verification allowance) I don't trust much! You know what is ironic is that I just went to Portabello Road outside London for some antiqueing and walked right past George Orwell's house!
That explanation does not account for the items that were deleted that werent even involved in dispute. From what I have read at this site, the CBAs are deleting items that were not even in question. That would mean that they are randomly dropping positive items and in return falsely reporting our credit histories b/c our files are INCOMPLETE.
No, you don't sound like a conspiracy theorist to me, Mist. In fact, what you say makes perfect sense. If the CRAs feel "strangled" by the 30-day limit, that just may be what they're up to, trying to get some ammo to up the limit to 30 or 45 days.
The CRAs would have a tough sell on Capitol Hill on this one. There would be hearings and questions. The most secret inner workings of the whole industry would be revealed. Has anyone watched a hearing? Those Senators and Reps smile a lot, but they do manage to rip a lot of @ssholes too! So bring on the hearings! We'll see a parade of consumers whose lives have been ruined from the CRAs! Maybe Congress will change the investigation time to 15 days! SK
One way to start, then, would be to write a letter to each of our Senators and Representatives and advise them to have EACH member of their family and extended family as well as their close friends and neighbors do a check on their own credit profiles with the Credit Bureaus. We all know that many of them will find numerous mistakes. They should then be encouraged to try to clear up those mistakes as we have been doing. Can you just imagine what the Senators and Representatives would find out in this way????
Yea, but wouldn't it be so nice to name drop? <Begin Lame Satire> Hello, I'm Senator Airbag's brother. I have this little chargeoff on my credit report. Do you good folks know how I might go about getting this off my credit report? Yes Sir!! We don't tolerate innacuracies here! We strive for 100% satisfaction! Thank you so much for bringing this error to our attention so we may have the opportunity to serve you. Thank You! TransEquiFerian "We're Here For You!!" <End Lame Satire> SK
We don't need to be slowed down in getting our reports corrected. Not so =What they can do is correct the errors we point out, and that does not mean deleat the account!
Here is a better Idea : Require correction upon receipt of customer dispute! Even one day of guilty untill proven inocent is too long!
"Here is a better Idea : Require correction upon receipt of customer dispute! Even one day of guilty untill proven inocent is too long!" Wouldn't that be something! I'll bet if they had to do it that way each and every dispute would be done real fast! SK
Sure it would be fast . Say they varified within 3days to put it back on. This tells me that if they can do it that quick to put it on thay can also do it that fast to take it off.
