A collection agency keeps on calling me about a debt discharged almost 7 yrs ago. Its also past SOL. What can I do?
Depends on what you mean by discharged. If you mean that you filed bankruptcy and the debt was discharged at that point, you can have your attorney threaten them with contempt of discharge order (or something like that - I can't remember technical term for it.) If you mean that the debt was written off as a bad debt, then you need to check the statute of limitations for your state. If it is almost 7 years old than it is most likely past SOL, meaning you have a defense if they sue you. However, they can call you for as long as they want, unless you tell them in writing not to. You can always demand validation and threaten to sue them for violations of the FDCPA if they can't validate their collection attempts. In any case, don't sweat it - they're just penny bottom feeders. Poochie
