Contacting court RE:BK???

    I read something about this somewhere and canâ??t seem to find the information on it again.

    Someone suggested writing to the courts requesting information on a BK. I am going to attempt to have BK removed from my reports. Someone said that if you wrote to the court and gave the case number they would provide you with the same information that will be available to the big 3 when you dispute it as not mine.

    Has anyone heard of this or have any information pertaining to this????

    I think you are referring to the tactic that works as follows:
    -you write to the BK court requesting the file with your case number.
    -the bk court supplies the file to you (or your attorney) under the FOIA
    -while the file is out of the courthouse, you dispute the BK with the CRA's
    -when they go to verify the info at the courthouse they cannot since the file is missing, hence the BK is removed!

    That is the theory - HOWEVER -
    if the CRA subscribes to a reporting service for public records (All do) then when the missing file is replaced, and the service reports it again, it will show back up on your report
    also, nowadays with electronic filing, etc, the fact that the physical paperwork is there or not may not matter

    All I really want is to see is what all is included in the file. How can I go about getting that information?

    Your attorney should have your case information
    Also you can use the PACER system to look up BK info. This might be a subscription service - I'm not sure...maybe this is what the attorney would use also.
    You could always go to the court clerk and request a copy of your file
