I had a BK7 discharged over a year ago. The holder of my HELOC is still reporting $25K owed and charged off as bad debt. I have disputed repeatedly with all three bureaus to no effect. I dropped it for a while but now I want to nail the Q(*%(%) - where to start? If possible, I want to try not to mention the BK specifically as it is not showing up on Equifax and I don't want them to put it there. Can I just send them nasty but unspecific letter telling them they have 10 days to update correctly or else? And should I also demand validation procedures from the CBs? Please advise - I've been out of this world for a while so I feel rusty. Thanks Poochie 622 and wanting to climb...
A lawyer on another board suggested I sue them and the CRAs for violations. Can someone direct me to the appropriate statutes and case law? There are actually 2 incorrect accounts that have been repeatedly "verified" by the CRAs, so from what I can tell I have these violations: Creditor 1: - 3 counts (1 for each CRA) Creditor 2: - 3 counts (1 for each CRA) CRAs - 2 counts each (1 for each account verified) Total of 12 counts for violations - am I wrong? I'd appreciate any or all input, as I want to do this myself in small claims court. Thanks! Poochie
Have you considered debt settlement? Go to http://www.superiordebtrelief.com to find out how to settle your debt for 50% of the total debt amount.
Well if the HELOC was included in the BK then by all rights it should report as IIB. You might want to go thru the forums a twww.creditboards.com and click on the bankruptcy forum there. I've read someone doing the same exact thing as you are describing. Good luck.
