OK I get really confused about the laws regarding OC, utility companies, etc. This is situation: Fiance has an old BellSouth bill showing balance of $208. It's being reported by a CA called CBCS. I sent a pansy-ass letter (can I say "ass" on this board?) before I found this board. I had already disputed with the CRAs online and it has been "verified". Questions are: 1) Are utilities like BellSouth bound by SOL? Are their collection agents? 2) Is it possible to settle (pay for deletion) with a utilty or their CA? Basically what I am thinking is that this one will never come off without a settlement, but I am concerned because it is a big utility that never asks for signed docs when you sign up for service. (and someday, when I actually start on my own reports, I have a thousand dollar BellSouth bill that my dear son ran up calling some chick in Australia that he met on the internet a month before he left for the Marine Corps - this information could be useful to me, too) HEY!!!! I just figured something out! This damn BellSouth bill really isn't his! He moved to SC before the year they show the opening of the BellSouth account! Holy Cow! Should I still send the same validation letter?
SOL applies to everyone. Some utilities will delete for payment and some won't. Just depends on the rep you deal with. Since there aren't any signed contracts utilities normally are easy to delete because of this. Some people have had success filing a fraud claim with the phone company. My experience has been that after 2 years they stopped verifying with the CRA.
This is over 2 years old. My fiance got the fraud claim form but it said that you have to submit police reports with it. hmmmm taking a closer look at what they sent (the CA for the phone company) it shows date of disconnect as 11/09/98 and the CRA report shows account opened in 2001. hmmmm Everything else looks right. But it's still past the SOL and it's still reporting the wrong dates on the CRA. Says it requires 3 proofs from list: list is: Copy of utility bills in your name showing different address during the time noted Copy of your drivers license showing different address during time period Copy of lease or rental during time period Notarized statement from township or courthouse stating residency during time period Notarized statement from attorney stating particulars Official document from your postmaster stating different home address during the time period And "a police report must accompany the three proofs" Then there is a long "fraud questionnaire"...name, address, ss#, etc., etc., and a section asking questions about residency, if you've ever had the disputed phone number, if you had phone service with someone else during the time period, on and on and on....
OK, since SOL is past, even if they try to sue, they can't collect as long as he shows up in court and says, "it's past the SOL". So. Would my next step be to try to settle for paying this in return for removing it from all credit reports? I mean, otherwise, I really have nothing to lose. Also, I wonder if CBCS is part of BellSouth or if it's an outside agency?

LET ME SEE...they will pay in full ONLY if we delete the account from their credit report... OK...that means that "IF" we don't delete...WE GET NOTHING... HUHHH WHAT SHOULD WE DO???
I have a validated electric company collection that is past SOL. I have sent two different letters almost 6 months apart offering payment in full for deletion and have been denied in writing both times. I would think they would be eager for the money. It has never been turned over to CA and the electric company is reporting it. So I am stuck on what to do.

Re: Re: correct me if I'm wrong PLEASE But the 7 years for the CRA isn't up...just the 4 in California for the responsibility. Actually it is just on DHs and not mine. The current account where we live now is in my name. Of course they don't report my good payment history... just nail him with the old baddie. I even provided proof of a medical emergency during that time frame with our daughter in the Goodwill and they said NO. :-/
