my court case against a cra is at 1:00 pm cst. I only live about five minutes from court so, I will post as soon as I get back. I am very nervous, it feels funny being on the other side of a lawsuit.
I won, I won, I won. default judgement for $3000.00 because they did not show up. Service was May 9th so they had plenty of time I still had to present my case and show damages (thank you Marie!!). I am sooo glad a had a copy of the FCRA with me, because the judge had questions about jurisdiction. I had copies of everything and just kept stating over and over how I wanted my report to be accurate. Of course, they can file a motion to dissmiss, but I am thinking I am getting some cash and deletions outta this. they have to have a good reason for not showing up in court!
Way to go. Congrats. I knew you'd be ok. Your only glitch may be in trying to collect. If you have any problems, get a writ of restitution from the court and send the sheriff out to attach equipment. They'll pay then. haha. Great job!!

thanks everybody. as for details. filling out the form was simple. I did not have to do a formal pleading like Whyspers did for federal court. I just listed it as "violations of the fCRA, refused to correct my credit report" I recommend that you use the pleadings because it helps you organize your case. Whysper's web site was very helpful,because it also showed me how to organize my information for court. My case was good, but not the strongest. Please make sure you have a copy of the FCRA. I want to thank lizardking,psychdoc, marie, Christi and whyspers for sharing their stories and success with this board. I am filing on a collection agency on Friday <grin> I am so ready to do this now! The court will notify experian of the judgement via certified mail, along with instructions on how to pay. I expect to receive a phone call or letter very soon!
Congratulations!!! Wooohooooo!!!! My guess is that they won't try to have the judgment vacated, simply because it would cost them more in legal fees, etc. than it would just to pay it. I had forgotten you were suing Experian! Let me tell you what has happened in my Experian case...lmbo. I found out who their attorney is yesterday when he called to ask for an extension. Its Jones, Day!!!! Only the largest law firm in the United States. Only the law firm who's litigation department was named as "best litigation department" by American Lawyers Magazine this year! Aeeiiiyyyyeeee! I guess they took my little ole lawsuit seriously, huh? Will confess I was briefly intimidated...lol. You did good, girl! You ought to be very proud of yourself and celebrate!!!! L
