i am in the process of disputing a loan from a bank i had from the year 2001 i'm disputing it with equifax it's on the 3 week. Friday in the mail came a statement from the bank from there consumer loan officer stating "please be advised that if the sum of $2,722.72 is not paid in full within 10 days from the date of this explanation of calculation of deficiency, we will refer this account to our attorney or a collection agency for collection action" my question is aren't they in violation when they sent a collection notice while this account is in dispute. if so which letter or what kind of action should i take. I also have proof that the account is in dispute i have a copy from equifax stating on the report reinvestigation in progress. thank in advance for helping me.
There is nothing illegal with what they are doing. I hate to say it, but it appears you have "awoken the beast".
Only illegal if it was a collection agency you were dealing with and you had requested validation from them.
all i'm saying is don't they need to prove to me first that it is mine, instead of sending me a collection bill?
