Situation: 1/31/02 -- Sent dispute of 3 items on report to experian with request investigation procedure included in letter. 2/3/02 -- CE marked these disputed items as "Under Investigation" 3/1/02 -- EX sent me the results of investigation, 2 were verified, 1 was verified and updated. CE no longer listed these items as "Under Investigation". No Information was given as to how these items were verified. 3/10/02 -- Sent letter requesting the procedures of verification to EX. Today -- CE shows these items as "Under Investigation" again. QUESTION: What should I do next? Send in another round of disputes or wait 30 days? T-MAN
If I remember correctly, they have 5 days to provide notice of receipt of your request, and 15 days to provide you with a procedural description. This is in Section 611 of FCRA. They, therefore, are in violation of FCRA and leaves them wide open for you to collect your $1000 per violation.
