three questions for anyone here I'm taking a poll and want to forward that info to the FTC for further review. 1) has ANYOne been denied procedural requests and have been told that if they want that info they have to subpoena it? 2) has anyone ever gone that route and actually tried to subpoena the records? 3) has anyone filed a suit and included the failure of a CRA to comply with procedural request ? your answers would be much appreciated thx I will post the outcome later
I've been told that they don't keep the records after the verify the info and I should contact the OC/CA if I have any concerns. This was from TU. EXP keeps telling me they can't reinvestigate. I've been to busy to file action against them. Seems like a slam dunk because the literature from EXP states you have the right to request procedure. I think TU would look foolish telling the judge that they don't keep records.
come on guys doesnt anyone have this issue to report? if you do please file a complaint with the FTC right away this will get them to look into the matter if they get enough complaints. thx
I am in the middle of dealing with Experian on this. Sent an ITS letter to them for it. They sent a "previously investigated" letter in response. I am filing a complaint with the FTC and filing suit. Will keep you posted.
The "literature from EXP states you have the right to request procedures" because the FCRA requires that they notify the consumer that they have the right to request procedures.
I realize this and requested it but they always respond with their usual saying verification docs not available or use other stupid responses. I was wondering has ANYONE ever recieved the actual response of what METHOD they used. or are we just to add that to the list of violations when we sue, because they never comply?
There is a guy in my town that does credit repair and he told me that suing on the procedure vioaltions has gotten him deletions. He says they settle before going to court, but it takes you to file to show them your serious.
