CRA's & child-support listing error

    Hi Folks.

    1. Ordered my credit report and disputed the accuracy of a child support arrearages they listed.

    2. Aafter 30 days, the CRA's send back another report, saying that the account has been verified as accurate when I know thats " BS"....

    3. So, I emailed this matter to the attention of the CSED supervisor , and included legal documents, specifically a court order from the judge clearing me of any arrearage owed to the state child support agency.

    4. but the state child support agency continues to report me as owing arrearage and "in collections" despite the court order exonerating me of this,
and 90 days later, still no fix.

Should I begin considering suing the CRA for this erronous reporting, or lay the blame on the State CSED for thier erroneous reporting dispute giving them a copy of the legal documents exonerating me of such arrearage?

Question: Who should I gun for? CRA for failing to confirm accurately or the CSED for failing to report accurately? Thanks in advance.

( I was never behind from day one, but this is a case of Interstate Jurisdiction between two agencies, Arkansas and Oklahoma. Arkansas has been pretty poor communicating to Oklahoma all payments being sent to them, and meantime, Oklahoma has no idea Im current with my payments and just notch it up to another month's arrearage.)

thats the backdrop in a nutshell.

    Ray.

    Re: Re: CRA's & child-support listing error

    Explanation:
In the former (going after the CRA) it appears they "did their job" by stipulating the account has been confirmed as accurate.

Now my task is to confirm "whom" did the CRA's contact to get that invalid information confirmed as accurate, assuming they're telling the truth.

In the latter, I "think I iunderstand" that one can be awarded civil penalties of $2,500 for each violation
and I dont want to tip my hand just yet, I'm paranoid if I do, they'll fix it to avoid a civil lawsuit.

YOu can tell I'm very very green in this area, but all the information here has really help me to develop my own backbone in pursuit of fixing all the false data inside my credit report.

Of coruse, like everyone else, I filed BK in 1999 and I wish I hadnt now that I see all these options that I could have learned about (like debt negotiation)

The impact of life after BK translates into short term cash shortage, which means an inability to put up front legal fees to pursue a lawsuit unless I can tie someone up with a contigency fee since this is a pretty good chance of presenting data to the judge that these arrearage claims all these years amount to false filing and negligent handling. Me thinks, anyway.

Fixing it does not erase the violation.

I didnt know that tidbit! Looks like IM going to be putting that to the test in the near future, from all available information seems best approach at the moment points to sending all supporting documentation to the CRA's and let the CRA have 30 days to hash out between these two agencies or delete the accounts.

or file suit after 30 days and if theyre still adamant about the accuracy of the dispute! I sure would like some cash if they cant work between two agencies within 30 days, (big evil grin)

Let me illustrate it this way:
If you steal an item from wall mart today and put it back on the shelf tomorrow did that erase the crime?
Can WaL Mart still prosecute you for shoplifting even though you put the item back on the shelf?
