Credigy Receivables Inc.and Lawyers

    Hello

    I'm a new member and I could really use some advice. I recently (12/26/03) got a letter from some lawyers (Stewart and Associates) claiming to represent a Credigy Receivables Inc. They want to sue me for about $2,400.00. I don't have the letter with me at the moment so I don't know where they are located but I live in Ca.

    I called the number on the letter but it was after-hours and I just got a machine that said Stewart was a debt collection agency. I'm a college student, unemployed, and I don't own any property. My questions are:

    1. Would they really take me to court for that amount of money?

    2. Has anyone on this board dealt with any of these parties, are they really lawyers?

    3. Where do I go from here?

    The letter said Credigy Receivables Inc. and they got the debt from First Select. I've never heard of any of these companies. I've seen another member on this board who mentioned Credigy once.

    wow!

    You're right. Credigy it is.

    Used to be a German company. That's what GmbH means.

    Now appears to be registered in Iowa.

    I'm still looking.

    This message is for warp. Your case sounds just like mine. My account was with First Select and I made my payments to First Select. Then one day I called to make my payment, they told me to call Credigy. I called Credigy and they told me First Select sold my account to them and they have furhter information rather than told me to continue to make my payments like I did with First Select. Then June 2003 I called to make my payment they told me to call Credigy. I found out that the company I had been making my payment with was not Credigy but rather they served as a collection agency for Credigy. They gave me the # to call and this "Credigy" said they do not have my account. Recently, I got calls from "Credigy" asking me to pay off my balance. They told me that I have missed too many payments and that I have to pay in full. I felt this is not my fault since they have my account screwing around like this. Who knows the next time I call someone will tell me this is not Credigy. What should I do? I asked them to send me a letter stating my debt and such. In your case, did you get any luck finding anything that could be a help to you? I could have used some of your advise.

    My daughter received a Fedex from Stewart & Associates, P. C. Attorney's At Law saying their client: Credigy Receivables, regarding First Select saying they planned to obtain a judgment against her if she didn't contact their office within 10 days by calling 866-204-3457. They sent her a copy of a Plaintiff's Original Petition that names Discover as the OC. This debt was made in college and last payment was 3 years ago this month. We are in TX, with 4 years SOL. She is so stressed about it she asked me to see what she should do. I recv'd help here and other boards, but mine was all over 7 years and just took sending "the letters" and it was taken care of (thanks to you all). We have had the letter for several days. Please, tell us what to do now. I know the C&D letter is out, is there one for someone still in SOL? I might mention at the bottom of their letter it states it is attempt to collect a debt.

    I believe there is the violation of overshadowing in their letter.

    I googled "overshadowing" and I think you're saying she should have 30 days?
    They also put this in bold print "Although our office has not yet filed suit against you, please be advised that if we do not hear from you and arrange a repayment plan acceptable to us within ten (10)days of receipt of this letter, we will proceed with the filing of the attached lawsuit by a Stewart & Associates attorney licensed in your state."
    Another thing I thought strange (it may not be) on the front of the Fedex envelope, it had an Attention sticker saying ?If this shipment is undeliverable, or refused by recipient, DO NOT return shipment to Shipper. I signed for it, the guy who delivered it asked my first name, which is nothing like my daughters, so as far as anyone knows, she has never even seen it.
    Should she send a validation letter? Their letter is dated 5 days before the actual delivery, so we need to hurry I think.

    Sounds like it, if it is the first communication she has received from them.

    If it is the first communication, is there anything on that letter that says if you dispute this debt, within 30 days blah blah..?

    If so, where is it located, is it in a smaller font, lighter ink, etc?

    I went to the Bud Hibbs site that was listed above and looked Stewart & Assoc's up. He said it was a sham company and to contact him if a letter was recv'd from them. I sent him an email.
    They said 10 days and was in a bold font. She does not remember ever getting anything from them before. I still don't know if she should send a valdation letter, please someone, what do you think?

    I have just realized that Credigy Receivables has a judgement against me for over 24,000. THis debt occured originally from Discover and was 12,000 roughly. I went through a divorce and my exhusband was living in the house. I was never served how can this be? How can someone get a judgement against you if you weren't served? Apparantely service was done and was signed for but it was not me I was living at that address???? I was served 2 months ago to give up all of my financial records and appeared in a deposition, I don't have a dime to my name and I am a single parent of specail needs twins, what do I do?????
