I recently received a letter from a collection agency in NY, NY. It stated that I owed them $200 (plus a penalty of $45). They said that I made a transaction last year in September and my bank reversed the amount. The letter stated that it had evidence for my AVS(adress Verification Service), CVV2/CID, and even my IP address matched their investigations. I called the Colleciton Agency and spoke with an agent. I told him I had to find out what was going and I was not going to pay until I do. After about 10 mins on the phone, he tried to make me pay by giving me a discount? The collection ageny even had the nerves to charge me ANOTHER $150.00 if I disagreed with their findings. I called my bank and got them to send me statements for the months that I supposedly spent $200.00. There was NO SUCH TRANSACTION!!!! I also contacted the Internet company that supposedly debited the amount. I did do some money transactions with this company and I have an online account with them, but there was never a problem. I made a request of all the transactions I've made with them, and there was "NO SUCH TRANSACTION" for $200.00. I am now furious with this matter! Is there anything I can do? I want to sue these bastards if I can and show them not to mess with me again!! I want to put that Colletion Agency out of business for what I've went through...
What atty's I have contacted in the last two years nearly always tell me we have been sold out by congress and Clintons NAFTA agreement as well ,,,,& hurt the ability to get these creeps into court..Good luck
sue them if can! if the shop said there are no problems in your past dealings with them then who is this agency representing?
I have a question, so bare with me. I opened an account back in 2001. About three months later, I joined the military, and I sent Soldiers and Sailors act documents to the creditor. They did not honor the documents. When I got back, I had three months worth of late payments, and other things I am sure. Then in 2004, I went to Iraq, and since I was going to be making some extra money, I decided to try and pay off the debt. So, I set up 7months of payments, which would cover the time I would be deployed. They only made about 3or4 payments. Then they stopped. Well, I became so frustrated with this creditor, that I just finally gave up, and with all the late payments on my credit, figured it couldn't get any worse, as far as score goes. Anyway, October of 2007, I recieved a letter in the mail, from Midland Credit Management, saying that I owed around 3300 dollars. Well, I sent a VALIDATION letter to them, and I just recieved something in the mail, over 60days later. All they gave me was a copy of three bills that were late. My question I guess is this. The statute of limitations is 3yrs, on credit card accounts, which this was. The last payment was made on December 2004. Since three years has gone by does this mean that I am outside the SOL? If not, what should I do. The original credit limit was $1000, and now they have hiked it up to 3300? The copies of the three bills they sent did not validate the amount owed in my opinion. Here is what I sent to them, and told them to validate: 1. What the money you say I owe is for 2. Explain and show me how you calculated what you say I owe. 3. Provide me with copies of any papers that show I agreed to pay what you say I owe 4. Identify the original creditor 5. Prove the Statue of Limitations has not expired on this account. 6. Show me that you are licensed to collect in my state. 7. Provide me with your license numbers and Registered Agent. Also, in the letter I stated that they had 30days to respond. It has been over 60days. Anyway, what should I do. Do the three copied bills they sent me mean I should pay? They really didn't comply with what I requested they prove. Any advice would help. Thanks.
