Credit First NA bull*$%@

    I sent a request to Credit First NA to verify late payments. I asked for dates of payments, my signature on the account, etc...

    Credit First NA has reported 10 times 30 to EX and 30 times 30 to EQ). In addition the account is listed as charged off/paid in full with both EX and EQ.

    I received a response back stating:

    The report accurately reflects how payments were received in relation to our account terms. We have agreed to report factually and will not violate the trust of other national credit grantors and the credit bureaus by altering correct reports.

    How in %$#@ is this accurate if they report differently to two different CRA's. I want proof. I also like that they are bound by trust to other credit providers and the CRA's. What ever happened to the FCRA???? Next step help?

    I think your right to ask for an account history may fall under the fair credit billing act. Personally, I would write another, strongly worded letter demanding an accounting for the acct., not just some b.s. response. You might state that if they report accurately and won't violate the trust etc., how can they report different things to different cra's. But don't give details. Remember, you have the right to see a complete account statement.

    It was charged off but paid in full?

    I want it off my EX and EQ reports.

    Have you disputed it with the cra's yet? If not, I would definitely try that route.

    Yes I have deleted from TU verified with EQ and EX. The problem is I am quite sure when EQ and EX ask for verification from CFNA they get the same response as I got. I have a suspiscion they have no payment record after charge off, therefore they just say payment history is accurate.

    If they report late payment history, shouldn't they have to verify to me if I am requesting this information? Additionally, doesn't the FCRA require all info reported be accurate? or else delete if it cannot be verified?

    Yes it does. If I were you, I'd go to the FTC website and read the FCRA, FDCPA and FCBA.
