Credit Guru's Need your help

    I received some hospital services and a claim for filed for $81 with Cigna. Cigna refused to pay claiming that the service wasn't covered. I knew it was just a mistake so I called Cigna a few times to explain my position. In the meantime the hospital sent the item for collections. I talked to the Collections company about my issue. Eventually Cigna paid the money to the hospital and agreed in a letter that it had made a mistake. I send the info to the experian and asked to delete the record. Experian says the collections agency updated the record to paid but refuses to delete the record. I asked Experian to explain the details because it surely is a mistake since I didn't ever really owe anyone. The send dispute came back with the same reply. I called the collections agency and they say that I deserve it since I didn't resolve the issue in a timely manner with the Hospital. I explained that I was and it just took a while to clear up the matter. No luck!!! I threatned to sue her but want to get your thoughts on this matter. Also, I called the hospital and they said yes they received the payment from the insurance company but don't have any control over what the collections company does. They have sent information to the collections agency that the amount had been paid and as far as they are concerned they can't do anymore. I need help to these questions.

    1) Will the collection with paid status bad for the credit?
    2) Is it true that even if send all valid documents Experian can't do anything about the record?
    3) Do I have a legal basis to expect the record to be purged from my file?
    4) Is there anything I can do to fix this problem?

    first off - regardless if insurance was paying or not - you are the primary person responsible for your health payments. if insurance doesn't pay on time - which of course is most times the medical establishment can come after you - now since the account has been paid - yes, it will hurt your credit score as this probably now has a "paid collection" on your file

    however its not the end of the road - this account can still be taken care of - you will just need patience and perserverance.

    Your goal is to have this tradeline deleted from your file - first off do not call collection agencies - everything must be in writing - I can send you a few letters that have worked for me and friends.

    I would first ask the hospital to contact the collection agency (which it sounds like they're doing), but tell them to pull the account as it is not valid. Ask the hospital for a copy of the letter.

    When you know they've done that, send a validation letter to the collection agency, CRRR.

    When you get the green card back, dispute with the CRAs.

    If it's not removed, start your small claims lawsuits. The collection agency and the CRA are reporting inaccurate information.

    Thanks everyone. Here is what I am going to do after I read through all the posts so far. It's a combination of several strategies.
    Namely, Nutcase and dancerats strategy combined. I'll let you know how it turns out. Any comments before I commence my assult.

    1) Write a certified letter requesting the OC to send confirmation to CA that the insurace paid the claim and possible to delete the collection on my record. Not sure if they will do it

    2) Request validation from the CA

    3) If I get validation withing 30 days, Send them a certified copy of the receipts from the insurance and OC and request to delete the record

    4) If it dosen't work, Type a strongly worded letter along with paper work showing intent to sue in a small claims court and send it certified mail.

    5) Send letter to BBB and attorney generals office with a cc to CA.

    I had one more question that I needed help with. Can the OC tell the CA to cancel a collection and delete things off my record?
