credit laws

    Isnt there a law stating that a collection agency must notify you of a debt before adding it to your credit report..Thanks

    Unfortunately, no. (FCRA §623)

    I would like to have a law that would require the CRA (and/or the furnisher) to notify you if ANY information is added to your report at all. Why should WE have to pay to monitor our OWN information.

    I thought the ftc says that they must notify me of a debt and the action they plan to take.There was the credit card I got in 99 from united credit national bank ace.That they sent you books and a credit card but you only had $50 on the card because the books were billed to the card.Well I paid it out in 4/00 to genesis financial now a company named american fair credit association is trying to collect from me and the only way I found out is through a credit report.They say I owe them $300. Now you mean they can just pull my report and never tell me. Well that sucks...

    Yes it does suck.

    Fortunately you have a good chance of getting this off through validation. I would send CRRR validation letters to the CA that they must provide you proof consisting of a signed document as well as statements and bills throughout, that you owe the debt.

    There may be other state laws instructing the CA's but I do not think the FCRA or the FDCPA prevent the CA's from reporting ACCURATE information even without any notification sent to you.
