CREDIT PROBLEM. Need HELP! OK here it goes, I am getting married in one year. In checking out my fiances credit report I noticed two items that had the same account number. One was Arrow Financial which reads, Account legally paid in full for less than full balance. The other reads, Account charge off/past due 150 days. $1,420.00 written off. So I asked her what are these for?? Back in 2003 before we meet she said she was going to get a breast job. My reply was did you get them repoed ? She said she filled out a credit app at the plastic surgeons office and was approved. Then she decided she did not want to go through with the surgery. NEVER setting a date for surgery and when she called to let them know she decided against the surgery, they told her that they had to pay for the Anostelogist up front. Which Is BS, I asked her ten times if they or she had scheduled surgery. She said no, and she never called back thinking nothing would happen. I know thats bad but she was young! About a year later she started getting those phone calls, you know the ones, "Were going to sue you", "were going to take your house", "we have pictures of your kids" .....lol Anyway, being young and having no one to help, she made a deal with the Collection Agency. She paid for something she did not even get and now has two negative items on her report. I want to help get this right! Where should I start????? I would love to sue the Plastic Surgeons....
Credit problem Hi, I'm probably not much help, but, do you know any attorney's or is she eligible for legal aid? Maybe her work has legal assistance??? Keep researching, cause that is freaking riduculous, what they did to her. If it were me and I'm not expert, I would start with the Doctor's office that charges her. Type up an official letter explaining that you been in contact with the Attorney General's office (consumer protection unit) and that you demand that the situation be rectified. Good luck! Kerry
Before you get all fired up, know the facts... Read the agreement that your fiance signed that led to this charge. In addition to a credit app, it might also include some clause that says she's liable for certain charges even if she opts out. Review whatever documents she signed because if you do go to a lawyer, they'll need that to start with and understand the situation. Whatever your fiance says or remembers won't matter much if you don't have the documentation to corroborate those recollections. If you sue, what are your damages? Do you have documentation for them? Given how much of pain in the butt all this would be, it might just be easier to let it fall off in a couple of years. If it occurred in 2003, it'll fall off naturally in 2 more years. I'd just let it go.
Berru, Your post suggests that she has a duplicate reporting for the same debt. If the account # matches and the secondary "charge off" reporting is also with Arrow Financial, contact all 3 bureau's and fill out a consumer dispute form to atleast get the charge off reporting removed. I agree with ccbob in assessing what it's worth in the long run. Live and learn. Not much incentive for counsel to file suit via contingency on such a small amount and you'd probably spend equal to or greater to the amount she's already out of pocket to file suit hourly. JJAM
Just to make sure I understand... She didn't pay anything. She didn't receive any services. It's worth trying to get the duplicate report off (but I, personally, wouldn't hold much hope in that happening, but it's probably worth a try). Since there's not much I can see in the way of damages and they probably have a clause in there somewhere that allows this type of charge anyway... BUT, Because it's so old, you might try the "there must be some mistake" option with the office. Tell them you found this account on your credit report and don't understand what it's for because you (i.e. your fiance) never received any services. As such you'd really appreciate it if they could remove this from your (her) credit report and to contact the CA to have it withdrawn. They could go to court, but I'm thinkin' they might have a hard time explaining a charge for no services and probably would rather not. (Of course, I could be wrong...) But, in any case, I don't see that there's much to lose in trying to ask nicely. If nice doesn't work, you could go nutcase on them... But, after all is said and done, I still think the most bang for the buck at this point is just to wait it out.
Yea clarify....quote: " I noticed two items that had the same account number". I got the impression she Settled it, but then they reported the same account as charged off. Also, I read the post too quickly and over looked the 2003 yr. noted. Statute of Limitations most likely expired ( 3 - 5 yrs depending on where you live).
