This is the last ca left. It is only on exp. Don't know why I waited but validation letter is going out tomorrow. The oc is circuit city. what should I expect ?anyone? the account was charged off 8/97. opened in NY, sol 6 years. doesn't matter does it? I live in CA Where the sol is 4. Is this all that matters?
The SOL in NY would matter if they decided to sue you in NY. They would not could not sue you in CA because it is now passed the SOL. Not sure about the CA credit vision.
hey mindcrime, How woulld they go about suing me in NY? Has this happened to anyone here? these guys are in tx.
The SOL has not yet expired for NY. So, if they decided to sue you for the debt, they could only sue you in NY. If they came after you in CA, you could (and they probably know this) use the SOL as an absolute defense, while in NY, the SOL would not help you defend yourself. Since they are in TX, unless this is a high dollar debt, they wouldn't bother going through all that trouble (since it's half way across the country). Not sure if this has happened to anyone on the board.
I don't know how to link you to the right thread, but look at the one titled "Sue CA and CRA if not bonded." It's got a lot of information about Texas and the requirements for third party debt collectors operating in Texas. Includes email contact and numbers to call to verify if the CA has posted their 10K surety bond. If they are not in compliance, for $10 through a written request, you can even get a "certificate of no record" from the Secretary of State- Statutory Documents Division. Maybe this will help you...
In my experiance credit vision is BAD! The worst. They will not respond to any validaion letters, they wont mark any account as "disputed" and they wont settle. They will just ignore you and you will have to sue them. Candi
This is absolutely amazing. I was just getting ready to ask exactly the same question. I have sent them a validation letter, a dispute letter, and an intent to sue. They have responded with a standard you beter pay us or else letters. I'm going to sue the hell out of them. Will file next week. CBJ
Did you sue them? Can you tell us the details? Dont they have to be licensed in the state they are trying to collect in? Since I live in Idaho I can't imagine that many Texas CA's are registered here. CBJ
This isn't bad, this is exactly how you want them to behave. This is the behavior that gains you leverage. It is also the behavior that can result in cash in your pocket plus the deletions. Gib
This account is in my husbands name. It was circuit city. He is getting ready to sue them in the next few weeks. Yes, they will provide the violations. I think we have 8 now. I don't know their web site address but my husband looked at it once. It is so sleazy! "Millions of dollars of debt for sell" Flashing lights and crap.
