i.e., my mortgage was included in our chapter 7 back in 98 and was not reaffirmed. On my Experian report they are reporting me 90 days late 26 times - which is BS, isn't that 6.5 years of lates? Can they even continue to report after a bankruptcy?
If they are reporting as "included in bankruptcy, 0 balance" it isn't hurting you. If not, dispute it. I wouldn't send them any bk docs though. They may ask for them. If you plan on disputing the bk, remember, anything you send them will be used against you later.
I have alot of the same thing you're talking about (mine aren't a mortgage). I take it that you're saying they are reporting late for dates that are more RECENT than your BK. They are for me. Yes, it does hurt our CR which is why the OC is doing it. I just can't figure out how to make them stop! Since I've been disputing some TLs have been getting WORSE with more recent negs on accounts closed in BK years ago.
Ahhhh I misunderstood. If they're reporting current lates, then it's illegal. Get your ducks in a row (paper trail) and sue them. Chances are, it will never get to court (but be prepared) and you should get the accounts deleted and some cash out of it if they don't settle. We have a couple of OC's who are going to get a class action, I think, for this. Do searches for IIB - that's where the info is.
This is exactly what the Equifax CR says: Mortgage Co Date opened: August 1997 DOLA May 2004 (wrong...bk 7/98 and paid off July 2004) Description: Paid account/zero balance/real estate mortgage Last report on July, 2004: $0 balance/pays as agreed Seven year repayment history: 30 days late - 11/ 60 days late - 10/ 90 days late - 1 Dates listed are after the dismissal of the bk - 6/2004; 8/2000; 12/1999 etc (they are also untrue) From Experian (690 score so I don't think this one hurts as much) $0 balance / chapter 7 30 days 7/1998 90 days 8/1998 (just doesn't make sense - since when is one month 60 days?) TransUnion (706 score) DOLA - December 2002 Closed March 2000 Unrated or bk 0 lates So I guess I shouldn't bother with TU but the other 2 are definitely incorrect.
