Creditor or CA reporting to CRA

    I am confused. AMEX reported a charge-off to the CRA's. A collection agency, Coldata, is now contacting me for payment. On my credit report, all I see is an "inquiry" from Coldata, but no other notations. If the CA validates my debt and I negotiate payment for deletion, how am I sure they have the power to delete?
    Also, since AMEX is reporting the charge-off to the CRA's, do I validate with them first, then the CA?

    I have the same problem with an AMEX account listed as Charge Off, Profit and Loss Write Off appearing on all 3 credit bureau reports.

    I also had an inquiry from COLDATA but only on my Trans Union report with the message that COLDATA "obtained information from my consumer report for the purpose of an account review or other business transaction" this was dated in 1999.

    When I received my updated report, this inquiry was deleted. I actually did not know this company was connected to AMEX until reading through messages on this board.

    I have written AMEX letter after letter but have not received anything from them.

    If you have any luck getting a response from them please let me know and post an update to your situation.

    I've been disputing this account and another since December and haven't had much luck yet....

    You CANT. The CA is NOT reporting so they CANT delete anything. Be careful here.

    First, you may be jumping the gun. WAIT to see if the CA validates. Demand proper validation, chances are they can not.

    If you WANT to pay, try and negotiate payment for deletion from AMEX not Coldata. Amex is reporting the listing. You can do this during your validation with Coldata. This is what I would recommend you try to get accomplished if you can, it will make things loads easier.

    You can send validation letters to AMEX as well. The lingo needs to be changed slightly because original creditors are bound by the FCRA and collection agencies are bound by the FDCPA but they BOTH must validate the listings they make on your credit report with hard facts and relevant data. As I said, I would validate and negotiate payment for deletion with AMEX if I could.

    You should also validate with Coldata now. Since they just contacted you, your validation rights are "strongest" within this 30 day period so send ASAP.

    Thanks for your response and advice.

    I have tried to talk to AMEX, but they refer me to the CA. Assuming the CA can't validate, how do I negotiate with AMEX?
