Background: 1/6 recieved dunning letter from Robinson, Reagan, & Young. 1/9 sent request for validation. 2/21 recieve a letter "enclosed is your verification", and we will now proceed with collection of this account. The "verification" was a computer printout/fill in the blank that said: "Bellsouth Telecommunications Verification of Account" Someone wrote in my name, account number, balance due, and somebody's initials. 2/21 faxed them a letter that this was not proper validation. Today, I receive a letter dated 2/21 ratcheting up the collection effort. Saying if I have not made arrangements to pay, it will be reported to a national CRA. Below is my response, would appreciate any and all suggestions TIA Ms. K. Lynn â?? Account Representative Robinson, Reagan & Young, PC Attorneys at Law Suite 200 4460 James Robertson Parkway Nashville, TN 37219-1501 Re: Bellsouth Account No. xxxxx Dear Ms. Lynn: (yes that is the Rep's name) I am in receipt of your letter dated February 21, 2003, which is in response to my fax of the same date. Be advised that if you report this account to any of the national credit reporting agencies, without lawfully validating this debt, as is my right under the Fair Debt Collection Practices Act, I will immediately, and without delay, file suit against your firm for any and all violations of this act, violations of the Texas Finance Code, as well as violations of the Texas Business and Commerce Code. For the record, I dispute all of this debt, and until such time as I have received full disclosure of what constitutes this debt, whereby I can verify the accuracy with any and all records in my possession, I will continue to dispute this debt. Further, this is your notice that I have not dismissed the possibility of filing suit against your company for the already committed violations of the FDCPA and Texas Finance Code for your continued collection activities while refusing to validate. Give this very important matter the attention it deserves. Sincerely, jlynn CERTIFIED MAIL 7002 0860 xxxx
I likes. Gets right ot the point. I'm curious; did they indicate "disputed" status during the short period between receiving your letter and sending you the printout?
