WTF? I sent Collectech a validation letter CRRR regarding a Verizon Bill that they claim to be collecting. I have already paid Verizon, but yet they verified this as of 11/01 according to my Equifax. Well I get a note from the post office that they have sent it back without accepting it. What is my next step? What can I do. Thanks mizfixit - freedom777's spouse
COLLECTECH SUUUUUUUUCKS!!! They accepted my validation letter, but not my hubbys, so if anything happens I am gonna say BOTH our letters were in it. Some people have said to put in big black letters FULL PAYMENT INCLOSED on the letter! KHM
Keep them all in your file, build a paper trail. Next time send one CRRR and send a duplicate using either the lime green or just the receipt of mailing (.50) wonder what the judge will say when you sue them and show all the CRRR letters they refused and then produce the other receipts of mailings as well! Wow, I didn't realize people can refuse a certified receipt mail! I thought the postman just send the receipt , when he makes sure it's delivered to the right box. How weird! I was WONDERING how in the world you get a receipt, when you send mail to a PO Box that nobody can sign for!
You can refuse it. BUT just sending it may be enough tosatisfy the law. If you are served papers via CRRR and refuse it can be argued that you were served and they can go ahead with the suit. At least in my state. I have a letter waiting for me CRRR and I am waiting till the last possible day to pick it up as it may be trouble. They sent an initial notice 01/02 /02 and today they sent 2nd notice that it will be returned 01/19/02 if I dont get it. I'll pick it up 01/18 or something like that.
USPS has a little tracking thingy - not cert RRR, but a bar code they scan when the letter is delivered - it shows that the recipient got it, and you can track on the internet, just like with UPS.
Isn't that only if you "refuse it", not if you were not home when the mail person tried to deliver it, and then you forgot to pick it up before it was sent back. Right? What if you were out of town or something? Could they then go ahead with the law suit? Tuit
Re: CRRR Validation RETURNED To ME! Send one copy via FedEx. Nobody refuses FedEx, lol. Require a signature. (The FedEx airbill defaults to "signature required"; you actually would need to opt out by checking a box, so don't do that.) FedEx creates a beautiful trail online which shows your letter's progress to its destination. Some courts will even consider a signed FedEx delivery "proof of service" (i.e., as if the material had been delivered by a process server). In any event, that's all the proof you need. The CA will hate you. Doc P.S. If the CA uses a P.O. Box, you can't use FedEx, but don't despair. Use USPS Express Mail. It's even a bit cheaper than FedEx (although considerably more than CRRR). I believe you'll need to OPT-IN for a signature with Express Mail, though, although you'll want to get confirmation on that -- I can't remember at this sleepy moment.
Good point. I can't be sure on this one. I don't know. I would imagine you would have to prove that you were out of town.
Re: CRRR Validation RETURNED To ME! Here's a thought. Validation is your right under the FDCPA. You now have proof that this CA refuses certified letters from you. Although you don't have proof that they ACCEPTED AND RECEIVED a letter, YOU DO HAVE SOLID PROOF THAT THEY WILL NOT ACCEPT CORRESPONDENCE FROM YOU after attempting to collect a debt. Follow up with a lawsuit for violating the FDCPA in blocking your attempt at validation. Their refusal was probably the nicest thing they ever did for you. Rather than FedEx, go with small claims court. Doc
