as many of you know i was served by a local attorney here in the RENO NEVADA area last mth & with the FANTASTIC help from you guys i filed my ANSWER in december but i have a question that makes me curious .......... lets say nothing comes of this lawsuit meaning i hopefully never again hear anything from their attorney i mean im only broke w no assets no nothing sad to say so it would'nt make any sense for them to pursue and if they did & i lost i'd have no choise but to file BK , im told by a BK attorney i do qualify for chapter 7 BK if needed ( thats a last resort ) ....... MY QUESTION IS THIS - i last paid ANYTHING on the creditcard in apx Nov 2005 & in Nevada the SOL is 4 yrs so my SOL would kick in apx december 2009 BUT did/would that NOW change becouse they filed suit vs me & i answered it in december ?? if i do not hear anything again is my SOL on that card still up in apx december 2009 ???? thanx again guys , Julie in beautiful Nevada
You say you're already being sued - so what exactly is your question? By the way - wink, wink - hi from Sacramento, CA, a quick drive on Interstate 80 from Reno, in the summertime. Right now chains/snowtires and a PITA to get over the summit.
Assuming the lawsuit were to be dismissed without prejudice due to lack of prosecution or other cause, the original SOL would apply.
thanx 4 the replys ........ yes ive been sued as they filed the summons & complaint & i answered it in december ......... Apex mentioned something about "theres a chance that theres a possibility i MAY never hear from them again" as I THINK they were hoping for a default judgement , i mean hey , their like only sueing me with a wrong account number as ive never had ANY card from that bank with that card number ......... no papers were attached to complaint or anything just honestly a bunch of nonsense ........ im just wondering & honestly im hoping they go away becouse ive got nothing no money no assets no nothing really , its so bad a BK attorney told me im one of the few in Nevada that would actually qualify for a complete chapter 7 , lucky me , yup sounds like im just one lucky chic huh ......... since my fico as of january is 647 & my credit is really not THAT bad at all i really dont need to file but if i lose any suit i sure will , lucky lucky ........... i dunno guess im hoping they just go away cause i mean if they smell ANY money with me their nose has gotta be broken .......... guess my question is this ,THINK they'll just go away ??????? thanx Julie
