Dang!!! WTD???

    DH has a charge off from Verizon Wireless. Verizon is collecting! They verified through the CRA's, now what??? This is not his account!! He's never had a cell phone in his name, ever! Since they're the OC, they don't have to play by the FDCPA... Correct? Should I still send them a Val letter and see what happens?? Again, there's no way this is his account!! The date it was opened, according to his reports, is 01/96. They have the DOLA as 07/97, a few months shy of the SOL here....

    They just started reporting this 03/03. We want to buy a house and need this removed!!! Help!!!

    Does anyone have anything but a PO Box for these jerks??? That's the only address they have listed on his reports. No point in sending a CRRR to a PO Box...

    All the CRRR letters iI sent to po boxes were signed for, never had a problem.

    What is the PO address? I will help translate that to a real address.

    They will probably have you do a fraud affidavit if you tell them this was not opened by DH. Hopefully, the process will not be too painful.

    Ok, dispute w/the oc and if they don't mark it in dispute with the CRA's, then I have 3 violations (1 for each CRA if not marked) and the leverage I need... Correct???

    Wow, you are up early!

    I should be in bed, asleep. I'm in OR.

    Ok, I've been doing some reading...

    I think I'm covered by the Privacy Act, FCRA and the Fair Billing Act (maybe, the acct is listed as an open chargeoff). I just have to word my letter correctly. Does anyone have a letter to an OC involving these laws??

    Does this sound about right?

    I have sent 98% of CERTIFIED R/R to PO BOXES...with very few problems!!!

    2*Here is a little trick that most people don't think of. You can sue the OC for the disputed amount.
    3*Have you applied for the loan yet?

    3. Yes, we have been turned down by GMAC and are currently speaking w/my friends broker. He wants all our accounts (collections/total $2100) paid before he will move forward. Most of them are near SOL or older than two years. We're trying to get FHA insured...

    1*I would not pay it either.
    2*On the grounds they owe you the money. I did this twice once with a water company and another time with a gas company.
    3*looks like you got damages then.

    Hey, I hope you're not under the impression that FCBA applies to Accts. that are still open.

    It applies to accts that are "Open End Accts", as opposed to "Installment Agreements", (which are "Closed End Accts.").


    On your CR you'll see I1 or R1.

    R = Revolving (Open End Acct.)
    I = Installment (Closed End Acct.)


    A cell phone would be an "Open End Acct."
    (So YES, FCBA applies)

    An auto loan would be a "Closed End Acct."
