Okay, here's the deal: Got a Discover card in NM back in I think it was about 98. Anyhoo, joined the military in 2000. ANyhoo May of 2000 was my last payment. I came off of a deployment last November and called Discover to pay it off. They said I didnt owe them anything and I asked if they were sure cause I did. They said that I have a zero balance and never said anything about collections or a charge off. Never received anything in the mail... About a couple of weeks ago I keep getting these phone calls leaving just a first name and number. I dont call back unless I know who its from. So than they get a hold of my boyfriend (he was home when they called) and told them I owed a debt. So I called the cheesehead back. He tries telling me that I need to pay 650 for 6 months and that I need to pay 25% of the balance down for this month to keep it from getting "investigated". I told him I could not do it. I could only pay two hundred bucks. He also told me to default on my car loan for one month to pay him off and try to take out a loan or borrow money. I told him NO way...either he take my deal or leave it. He said it would be fine but I still needed to put 700 down and than I could pay 200 a month after getting off of the phone with his "client" Credigy. He works for Financial Recovery Services. So he gave me 48 hours. I went home did my research and told my supervisor about it the next day. So I called the guy back with my supervisor in the shop. The guy, Barry, wasn't giving me any information. Said his client was Discover (later found out it was Credigy) and that was all. I was getting frustrated and put my supervisor on the phone and he said he was my "financial Advisor" and needed to know of my situation. He got all sorts of information about the debt. Anyhoo, I still have no received anything in the mail. Yesterday 7/20 he calls me and I happen to be home. I told him to no longer contact me and I would call him once I got the bill (yeah, right...gonna send a actual validation letter) so he was tryint to talk over me but I wasn't listening and told him that I am telling you to quit calling me and by law you have to and once I receive something in the mail I will call you back, have a good day. And I hung up. So what are my rights here? Is it past the SOL? Also is telling me deceptive ways to get money against the law? I have done my research but still need help. Oh yeah I now live in San Diego, California and have since Oct of 2000. Please help...

I have another question...I just got my initial notification from the credit agency I have been dealing with on the phone. Anyhoo, the law says unless they are a relative or spouse they can not give details about the debt...he told my fiance about the debt that it is own to discovery and for the amount. Is that against the law?

Hey thanks for your help so far. I believe my SOL has run out because I live in California. The last payment was 5-2000 and the sol is 4 years in Cali. However, I opened the account in NM and lived there for three years prior. Anyhoo, I have stayed off the phone with him. Last time he called I told him to quit calling me and I will contact him when I received a letter in the mail. Which I just got. However, I'm not going to call him.
