My friend has a charge off with Cingular Wireless. She called me last night at 11:22 pm because... THEY CALLED HER AT 11:19 PM! I told her according the the FDCPA they cannot call after 9pm. I think one of her children answered the phone but their info is in her caller ID. BTW, this is not the first time they called outside of the hours they are allowed. Last time they called at 7 am... Can she get them for violations now or should she let them rack up?
Love she can bust them.... before i was into the credit repair and found this board, A few years back i'd receive calls way after the 9pm and as early as 7:15am EST. This creditor would call, when i go the oppty i expained i didn't want them calling me that late or the first thing before work. I've always been into computers and digital stuff so i decided to record them. Now their manager didn't believe his workers were calling out of compliance. I guess the East coast office trans calls to the West coast office after a certain time, so the calls were coming from the LA office. I fixed my fax software to double as my answering machine. I got a call and it started recording the msg, i picked up the phone and screamed at this guy for calling and kept asking him if he knew what time it was it was 10:20Pm why are you calling? He laughed and said we cant get you during hours so we have to catch you. I trans that msg into a .wav file and emailed the corp office with my complaint. I wished i'd knew more about my rights and the legal aspect because i could've owned that company. I only got a deleted collection item. They terminated the collector and sent me clearance letters. I missed that lawsuit boat. Have you friend document the times, and if possible save her caller ID log. The phone co can keeps records also, you're Bellsouth??
backspace, What is the name of the program you used? And can you tell me what you did to get your computer to record phone calls...
Mindcrime, sorry for the old post, was looking for something i sent a long time ago and noticed this one you responded to.. The program is WinFAX and in it they have a add-on for a voice mail anserwing machine. Now the programs simulates a Voice mail and records your messages in a .wav file, Now once you got the msg in .wav file format it can easily be sent via email as attachment, or converted and burned to a disk(Mp3)

Take pictures of your caller ID screens. Get a Tape answering maching. Most let you record conversations in progress.
